Sonderregelung | Special provisions (according to IAF ID 3:2011 and DAkkS regulations) „International Accreditation Forum IAF“ und „Deutsche Akkreditierungsstelle DAkkS“ 

In berechtigten Fällen kann eine Sonderregelung außerhalb vom regulären Zertifizierungsturnus für anstehende Audits angewandt werden. Es sind je nach Auditart verschiedene Sonderregelungen möglich.

In justified cases special provisions may be applied outside the regular certification cycle for upcoming audits. Various approaches are possible depending on the type of audit.

ÜBERWACHUNGS- UND WIEDERHOLUNGSAUDITS / SURVEILLANCE AND RECERTIFICATION AUDITS

Sofern es fachlich vertretbar ist und eine geeignete Informations- und Kommunikationstechnik eingesetzt wird, können Überwachungs- und Wiederholungsaudits i.d.R. zum Teil oder sogar vollständig remote, d.h. aus der Ferne und nicht vor Ort durchgeführt werden. Hierzu müssen verschiedene Randbedingungen erfüllt sein, die im Einzelnen im Rahmen einer Risikobeurteilung zu bewerten sind.

Provided it is technically justifiable and suitable information and communication technology is used, surveillance and repeat audits can usually be carried out partially or even completely remotely, i.e. not on site. For this, various boundary conditions must be fulfilled, which are to be evaluated in detail within a risk assessment.

Zertifizierungsaudits / Certification audit (audit stages 1 and 2)

Bei Zertifizierungsaudits ist grundsätzlich eine Auditierung vor Ort erforderlich, insbesondere eine Auditierung der Kernprozesse. Teile eines Zertifizierungsaudits können aber u.U. auch remote durchgeführt werden. Ist eine Auditdurchführung aufgrund der Corona-Virus-Notlage nicht möglich, kann das Vor-Ort-Audit auf einen späteren Zeitpunkt (nach Kundenwunsch) verschoben werden. Wurde bereits ein Audit Stufe 1 durchgeführt, kann ein Audit Stufe 2 über die bekannte Frist von sechs Monaten hinaus um weitere sechs Monate verlängert werden. Teile eines Zertifizierungsaudits können aber auch hier, soweit das fachlich vertretbar ist, remote, das heißt mit Verwendung von digitalen Informations- und Kommunikationstechnologien (IKT) vorgezogen durchgeführt werden.

For certification audits, on-site auditing is generally required, especially the auditing of core processes. However, parts of a certification audit can also be carried out remotely under certain circumstances. If it is not possible to conduct an audit because of the coronavirus pandemic, the on-site audit can be postponed to a later date (at the customer’s request). If a stage 1 audit has already been performed, the stage 2 audit may be postponed for another six months beyond the known six-month period, so that a maximum time interval of 12 months between the stage 1 and the stage 2 audit may be possible. However, in this case, parts of a certification audit can also be carried out remotely, i.e. using digital information and communication technologies (ICT), provided that this is technically justifiable.

Erstes Überwachungsaudit / First surveillance audit

Ein 1. Überwachungsaudit nach einem Zertifizierungsaudit muss primär innerhalb von 12 Monaten nach dem Abschluss des Audits Stufe 2 vor Ort durchgeführt werden. Ist das aufgrund der aktuellen Corona-Virus-Notlage vor Ort nicht möglich, muss vor Abschluss der 12-Monatsfrist ein Remote-Audit durchgeführt werden. Dabei ist zu prüfen, ob ein solches Audit nur zum Teil remote (z. B. mit einem zweistufigen Verfahren) durchgeführt werden kann oder vollständig remote durchgeführt werden muss.

Typically, the first surveillance audit following on a certification audit must always be performed on site within 12 months of the certification decision. Where an on-site audit is impossible based on the current coronavirus pandemic, a remote audit shall be conducted before the end of the 12-month period. It should be considered whether such an audit can be carried out partly remotely (e.g. with a two-stage procedure) or completely remotely.

Was ist ein Remote-Audit? / What is a remote audit?

Bei einem Remote-Audit wird, ohne physische Präsenz von TÜV SÜD-Auditoren vor Ort, das Audit (oder in bestimmten Fällen das gesamte Audit) aus der Ferne durchgeführt. Dabei setzt der Auditor digitale Informations- und Kommunikationstechniken (z. B. Videokonferenz) ein, Nachweise können außerdem im Vorfeld eines Audits ausgetauscht oder zum Abschluss einer Korrekturmaßnahme versandt werden.

Teile eines Audits oder sogar komplette Audits können remote durchgeführt werden, wenn alle für das Audit wesentlichen Inhalte und Prozesse auf diese Weise mit einer vertretbaren fachlichen Tiefe auditiert werden können. Dabei sind insbesondere die betrieblichen Aktivitäten, Produkte und Dienstleistungen, sowie die damit verbundenen Risiken relevant. Während Führungs- und Managementprozesse in der Regel ohne Probleme remote auditiert werden können, ist bei den Kernprozessen zu prüfen, ob hier durch ein Remote-Audit eine aus fachlicher Sicht ausreichende Nachweistiefe erreicht werden kann. Das muss von Fall zu Fall unternehmensspezifisch entschieden werden. Eine Remote-Auditierung von Managementreview, internen Audits, Stichproben zu Korrekturen und Korrekturmaßnahmen (insbesondere zu Abweichungen aus vorhergehenden TÜV SÜD Audits und internen Audits) ist in der Regel unproblematisch.

Nach Überprüfung des Remote-Audits durch die Zertifizierungsstelle und einem positiven Bescheid, kann eine Bestätigung erfolgen, dass das zertifizierte Managementsystem wirksam ist. Der verbleibende Teil der kalkulierten Vor-Ort-Auditzeit muss dann, sofern nicht ein komplettes Remote-Audit stattgefunden hat, innerhalb von vier Monaten nach dem eigentlichen Fälligkeitsdatum (Due-Date) vor Ort durchgeführt werden.

Wichtig: Ein Remote-Audit bedarf technischer Voraussetzung beim zu auditierenden Unternehmen: So muss zum Beispiel eine stabile Internetverbindung oder die Möglichkeit zu einer Video- oder Audiokonferenz (Skype o.ä.) möglich sein. Zudem muss eine Risikobeurteilung durchgeführt werden, ob bei gegebenen Randbedingungen ein fachlich vertretbares Audit durchgeführt werden kann.

In a remote audit, part of the audit (or in certain cases the entire audit) is performed remotely without the physical presence of TÜV SÜD auditors on site. The auditor uses digital information and communication methods such as video-conferencing. Documents can also be exchanged in advance of an audit or sent out on completion of a corrective action.

Parts of an audit or even complete audits can be carried out remotely if all contents and processes essential for the audit can be audited in this way to a reasonable degree of technical detail. Particularly relevant factors here are operational activities, products and services, as well as the associated risks. While leadership and management processes can usually be audited remotely without any problems, core processes must be checked to establish whether a remote audit can provide sufficient depth of evidence from a technical point of view. This has to be decided on a case-by-case basis and is specific to the company. Remote auditing of management reviews, internal audits, spot checks for corrective and preventive actions (especially with regard to nonconformities from previous TÜV SÜD audits and internal audits) is usually unproblematic.

After the review of the remote audit by the certification body and a positive decision, a confirmation of the effectiveness of the certified management system can be issued. Unless a complete remote audit has taken place, the remainder of the calculated on-site audit time must then be performed on site within four months after the actual due date.

Please note that remote audits can only be performed if the company to be audited has the required technical infrastructure, including a stable Internet connection or the possibility for video- and audio-conferencing (Skype etc.). In addition, a risk assessment must be carried out to determine whether a technically justifiable audit can be carried out under the given boundary conditions.

Wiederholungsaudit / Re-certification audit

Ein Wiederholungsaudit muss primär vor Ablauf der vorhergehenden Zertifikatslaufzeit durchgeführt und abgeschlossen werden. Ist das aufgrund der Corona-Virus-Notlage vor Ort nicht möglich, muss geprüft werden, ob stattdessen ein Remote-Audit durchgeführt werden kann. Dabei besteht in Abhängigkeit der Pandemie-Lage und der Ergebnisse der Risikobewertung ggf. die Möglichkeit einer vollständigen Remote-Auditierung oder eines zweistufigen Verfahrens mit einem Remote-Teil in der ersten Stufe und einem Audit vor Ort in der zweiten Stufe.

Bei positiver Zertifizierungsentscheidung nach einem solchen Remote-Audit als Teil eines zweistufigen Re-Zertifizierungsverfahrens, kann ein neues Zertifikat mit einer Laufzeit von weiteren drei Jahren ausgestellt werden. Zur weiteren Aufrechterhaltung dieses Zertifikats muss ein Vor-Ort-Audit mit der verbleibenden Zeit der kalkulierten Vor-Ort-Auditzeit innerhalb von vier Monaten nach dem Ende der vorhergehenden Zertifikatslaufzeit durchgeführt werden.

A recertification audit must primarily be conducted and completed before expiry of the previous certificate’s validity. Where an on-site audit is impossible because of the Corona virus pandemic, it must be assessed whether a remote audit can be conducted instead. Depending on the pandemic situation and the results of the risk assessment, there is the option of a complete remote audit or a two-stage procedure with a remote part in the first stage and an on-site audit in the second stage.

If the certification decision is positive (after such a remote audit as part of a two-stage recertification process) a new certificate with a further three-year period of validity will be issued. To maintain the validity of this certificate, an on-site audit covering the remaining calculated on-site audit time, including the certification decision, must be performed within four months after the expiry of the validity of the previous certificate.

Überwachungsaudit / Surveillance audit

(mit Ausnahme des 1. Überwachungsaudits)
Ein für das Jahr 2021 anstehendes Überwachungsaudit kann aufgrund der Corona-Virus-Pandemie auf ein beliebiges Datum im Jahr 2021 verschoben werden, sollte aber nach Möglichkeit bis Ende des Jahres 2021 durchgeführt werden. Die Regel, dass zwischen Überwachungsaudit und Wiederholungsaudit mindestens 9 Monate liegen müssen, ist ausgesetzt. Auch bei Überwachungsaudits gibt es die Möglichkeit der Remote-Audits (siehe oben "Was ist ein Remote-Audit?").

(with the exception of the 1st surveillance audit)
Because of the coronavirus pandemic, any surveillance audit due in 2021 can be postponed to any date in 2021. If possible, such an audit should be carried out by the end of 2021. The rule that there must be an interval of at least nine months between the surveillance and re-certification audits has been suspended for the time being. The remote audit (see above “What is a remote audit?”) option is also available for surveillance audits.

Sonderregelung Übergangsfristen / Special provisions for transitional periods ISO 50001 & ISO 45001 

Im Fall der Beeinträchtigung eines laufenden Zertifizierverfahrens durch die Auswirkungen der Corona-Pandemie können in begründeten Ausnahmefällen die Übergangsfristen der Revisionen ISO 50001 und ISO 45001 (OHSAS 18001) bis zu 6 Monate verschoben werden. Eine Verschiebung der Umstellung über die bisherigen Fristen kann nur dann von der Zertifizierungsstelle genehmigt werden, wenn einem Unternehmen die Umstellung auf die neue Norm bzw. Normrevision durch die derzeitige Sondersituation nachweislich termingerecht nicht möglich war. Weitere Voraussetzung ist hier, dass eine verbindliche Planung zur zeitnahen Umstellung des Managementsystems und zur Durchführung des zugehörigen Audits vorliegt.

Sonderfristen in begründeten Fällen:

• Die Umstellung der OHSAS 18001 auf die ISO 45001 kann bis spätestens 30.09.2021 erfolgen (bisher: 11.03.2021).
• Der Übergangszeitraum für die Umstellung auf die Revision ISO 50001:2018 endet spätestens am 20.02.2022 (bisher: 20.08.2021).
• Seit dem 21. August 2020 müssen alle Audit (ÜA, WA, Special Audits) nach der ISO 50001:2018 durchgeführt werden (bisher 21.02.2020).

If an ongoing certification procedure is affected by the impacts of the coronavirus pandemic, the periods for transition to the new ISO 50001 revision or conversion to ISO 45001 (OHSAS 18001) may be extended by up to 6 months. The certification body can only approve postponement of transitions/conversions beyond the applicable deadlines if companies can submit evidence that they have been unable to complete their transition to the new revision of the standard or conversion to the new standard because of the unprecedented situation at present. In addition, they must be able to submit binding plans for prompt transition/conversion of their management systems and completion of the respective audit.

Special deadlines in justified cases:

• Conversion from OHSAS 18001 to ISO 45001 must be completed by 30 September 2021 (previously 11 March 2021) at the latest.
• The period for transition to the ISO 50001:2018 revision will end on 20 February 2022 (so far: 20 August 2021).
• As of 21 August 2020 all audits (SA, RA, special audits) must be performed according to ISO 50001:2018 (previously 21 February 2020).

Sonderregelung | Special provisions (according to IATF) “IATF 16949 and all VDA 6.x Standards.”

„Die International Automotive Task Force (IATF) überprüft ständig die Auswirkungen des Coronavirus 2019-nCoV auf das IATF 16949-Zertifizierungssystem. Zuallererst ist unsere derzeitige oberste Priorität die Sicherheit und das Wohlergehen aller am IATF 16949-Zertifizierungssystem Beteiligten.

Das aktuell erstellte Dokument "IATF-Maßnahmen-Coronavirus-Pandemie-COVID-19-REVISION-6" ersetzt das zuvor herausgegebene Communiqué 2020-001. Zusätzlich zu den globalen Sonderfreigaben und Maßnahmen, die bereits im CBC 2020-001 veröffentlicht wurden, genehmigte die IATF eine wesentliche Änderung, die die Gültigkeit aller ausgestellten und derzeit gültigen IATF 16949-Zertifikate betrifft (im Abschnitt "IATF 16949-Zertifikate" beschrieben).

Zweck dieses Dokuments ist es, alle von der IATF anerkannten Zertifizierungsstellen und in der Folge alle betroffenen zertifizierten Organisationen und andere Interessengruppen darauf hinzuweisen, dass die IATF als Reaktion auf den Ausbruch des Coronavirus, der sich weltweit auf die Zertifizierungstätigkeiten auswirkt, globale Sonderregelungen genehmigt hat. Diese Regelungen und Maßnahmen sind nicht auf ein bestimmtes Land oder eine bestimmte Region beschränkt, sondern können weltweit angewandt werden, wenn die Audits und Zertifizierungsaktivitäten wie beschrieben betroffen sind".

Hier sind die wichtigsten Änderungen gemäß der 5. Revision der IATF-Covid-Regeln vom 30. Oktober 2020:

• Die Implementierung der Remote Audis für IATF & VDA 6.x für alle Arten von Audits (CA, SA, RA & SpA) kann sofort begonnen werden.
• Ein kürzerer Zeitrahmen für die Durchführung von IATF-Überwachungsprüfungen, spätestens bis 31. Dez.2020.
• Ab dem 1. Januar 2021 sind nur noch Audits vor Ort oder Fernaudits erlaubt. IATF-Monitoring-Audits sind nicht mehr möglich.
• Die aus der Rev.4 bekannten Regeln für die Planung von Audits können bis zum 31.12.2020 angewendet werden, jedoch wird dringend empfohlen, alle verschobenen Audits so bald wie möglich unter Verwendung von Fern-Audittechniken durchzuführen.

Bitte beachten Sie: Alle diese Sonderregeln gelten nur für Organisationen, die durch Covid- 19 betroffen sind. Wenn Unternehmen durch Covid-19 nicht betroffen sind, dann ist der normale Auditprozess gemäß IATF-Regeln 5 anzuwenden.

“The International Automotive Task Force (IATF) is constantly reviewing the impact of the coronavirus 2019-nCoV on the IATF 16949 certification scheme. First and foremost, our current top priority is the safety, and well-being of everyone involved in the IATF 16949 scheme.

This created document “IATF-Measures-Coronavirus-Pandemic-COVID-19-REVISION-6” supersedes the previously issued IATF Certification Body Communiqué (CBC) 2020-001. In addition to the global waivers and measures already published in the CBC 2020-001, the IATF approved a major change affecting the validity of all issued and currently valid IATF 16949 certificates (these are described in Section “IATF 16949 Certificates”).

The purpose of this document is to advise all IATF-recognized certification bodies and subsequently all affected certified organisations and other stakeholders that the IATF has approved global waivers in response to the outbreak of the recent coronavirus, affecting certification activities globally. These waivers and measures are not limited to a certain country or region but can be applied globally if the audits and certification activities are affected as described.”

Here are the main changes acc. to the 5th. revision of the IATF Covid Rules from 30. Oct. 2020   

• Implementation of the Remote Audis for IATF & VDA 6.x for all types of audits (CA, SA, RA & SpA) possible to be started immediately
• A shorter time frame for conducting IATF monitoring audits, latest until 31. Dec.2020.
• Starting from 1. Jan.2021 only audits on-site or remote audits are allowed. IATF Monitoring audits are not possible anymore.
• The audit scheduling rules known from the Rev.4 are possible to be used until 31.12.2020, however all the postponed audits are strongly recommended to be conducted as soon as possible with the usage of remote audit techniques.

Remember! all these Rules are only applicable to organizations directly disrupted by Covid 19. If there is no disruption, then the normal audit process acc. to IATF Rules 5th edition is required.

Sonderregelung | Special provisions TISAX® 

Wegen der aktuellen Corona-Virus (Covid-19)- Lage und in Rücksprache mit der ENX Association kann die TÜV SÜV Management Service GmbH an TISAX-Verfahren interessierten Kunden die kurzfristig Labels nachweisen müssen folgende Vorgehensweise anbieten:

• Assessments im Assessment Level 2 können weiterhin Remote durchgeführt werden.
  
• Assessments im Assessment Level 3 können aktuell nicht in gewohnter Weise, d.h. vor Ort durchgeführt werden. Entsprechend bietet die TÜV SÜD Management Service GmbH, bis auf Weiteres, interessierten Kunden die Remote Durchführung eines Assessments (welches die Anforderungen an ein Assessment Level 3 erfüllt) an. Nach erfolgreichem Abschluss des Verfahrens erhalten Kunden ein Label im Assessment Level 2. Gleichzeitig steht es Kunden frei, sich zu einem späteren Zeitpunkt via „Upgrade“ und mit geringerem Vor-Ort Aufwand im Assessment Level 3 labeln zu lassen.
  
• Sollte ein Label im Assessment Level 3 erst zu einem späteren Zeitpunkt nachgewiesen werden müssen, steht der in der Verfahrensordnung vorgesehene, „klassische“ Weg offen.“

Due to the current corona virus (Covid-19) situation and after consultation with the ENX Association, TÜV SÜV Management Service GmbH offers the following procedure to customers interested in TISAX assessments who have to provide labels on short notice:

• Assessments in Assessment Level 2 can still be performed remotely.
• Assessments in Assessment Level 3 may not currently be carried out in the usual way, i.e. on-site. Accordingly, TÜV SÜD Management Service GmbH offers interested customers remote assessments (which meet the requirements for Assessment Level 3) until further notice. Upon successful completion of the assessment, customers will receive an Assessment Level 2 label.

  Customers are free to upgrade to Assessment Level 3 at a later time and with reduced on-site effort.

• If labels in Assessment Level 3 have tob e provided at a later point in time (i.e. after the accute pandemic phase), the standard way of assessment, provided in the „Participant Handbook“ is possible.

Sonderregelung | Special provisions IRIS Certification® 

Aufgrund der aktuellen Coronavirus (COVID-19)-Situation und den damit verbundenen temporären Regeländerungen, sind die durch die UNIFE zugelassenen Zertifizierungsstellen vorübergehend nicht in der Lage, Audits im regulären Rahmen durchzuführen. Daher steht das IMC (IRIS Management Centre) in engem Kontakt mit den Zertifizierungsstellen. Diese sind weiterhin die Hauptanlaufstelle für alle betroffenen Unternehmen.

• IRIS-Audits werden für betroffenen Länder gemäß der offiziellen UNIFE Länderliste ausgesetzt und daher verschoben (siehe Liste im Dokument "IRIS Certification® rev. 03 COVID-19 – Communication vom 23/03/2020“ unten), bis die Situation wieder stabil ist.
• Wenn sich Ihr Audit aufgrund von Covid-19 verzögert hat, kann die Gültigkeit Ihres Zertifikats verlängert werden. Ihr Unternehmen wird weiterhin im IRIS-Portal sichtbar sein.
• UNIFE-IMC entscheidet, wann Audits wieder gestartet werden.
• Hierzu wird durch das UNIFE-IMC die Länderliste auf der IRIS Homepage (www.iris-rail.org/) entsprechend aktualisiert.

Due to the current coronavirus (COVID-19) situation and the associated temporary rule changes, the certification bodies approved by UNIFE are temporarily unable to conduct audits in the regular framework. Therefore, IMC (IRIS Management Centre) is in close contact with the certification bodies, who themselves are the main contact point for all the affected companies.

• IRIS audits are suspended and therefore postponed for affected countries according to the official UNIFE country list (see list in document „IRIS Certification® rev. 03 COVID-19 – Communication of 23/03/2020“ below) until a stable situation is back.
• If your audit has been delayed due to Covid-19, the validity of your certificate might be extended and your company will still be visible in IRIS Portal.
• The re-start oft he audits is deemed to a decision of UNIFE-IMC.
• For this purpose, the UNIFE-IMC will update the list of countries on the IRIS homepage (www.iris-rail.org/) accordingly.

FSC issued several derogations and interpretations related to COVID-19. These derogations and interpretations have been published in a single volume, together with related frequently asked questions. Sonderregelungen AZAV (nur in Deutschland relevant / only relevant in Germany)

Die Ausbreitung des Coronavirus (SARS-CoV-2) in Deutschland und auch weltweit gewinnt erneut an Dynamik. Infolgedessen ist die Wahrnehmung von Angeboten von öffentlichen und privaten Bildungseinrichtungen auch im Bereich der Arbeitsförderung vor Ort untersagt.

Dies hat zwangsläufig die Aussetzung der Präsenzunterrichtszeiten an nahezu allen Standorten der zugelassenen Träger zur Folge. Die Bundesagentur für Arbeit und die DakkS haben deshalb verschiedene Sonderregelungen und Vorgehen veröffentlicht.

Beispielsweise kann unter bestimmten Voraussetzungen von stationären Lernformen auf alternative Lernformen umgestellt werden. Hier müssen gemäß der DakkS-Vorgaben aktuell folgende Schritte eingehalten werden:

• Der Träger legt eine Übersicht der Maßnahmen vor, die (abweichend von der ursprünglichen Zertifizierung) unter Anwendung alternativer Lernformen durchgeführt werden sollen.
• Die fachkundige Stelle (TÜV SÜD) stellt für die beantragten Maßnahmen eine Vorabbescheinigung aus.
• Der Träger reicht die notwendigen Unterlagen zur Bestätigung innerhalb von spätestens acht Wochen bei der maßnahmezulassenden fachkundigen Stelle (TÜV SÜD) nach.
• Die fachkundige Stelle (TÜV SÜD) prüft die Einhaltung der Anforderungen.
