US: CPSC strength registration program for durable infant or toddler products

The Consumer Product Safety Commission (CPSC) has issued a final rule¹ regarding the consumer registration requirements of durable infant or toddler products under the Consumer Product Safety Improvement Act (CPSIA)². The rule will take effect from 24 October 2019, with exception for contoured changing pads until 24 September 2020, providing products firms one-year transition period to establish a consumer registration program.

Rulemaking³ started in October last year, the CPSC proposed to update the definition of ‘durable infant or toddler products’, clarify the scope of listed product categories, and add six additional product categories that subject to the scope. Comments were generally supportive, the Commission later finalized this rule by adopting the proposed amendments without modification.

A durable infant or toddler product means a product that intended for use or expected to be used by children under 5 years old. CPSC requires manufactures to establish consumer registration programs providing a means for consumers to register such products, so that consumers can receive direct notification in the event of a product recall.
