USA: California publishes new safe use determination under Proposition 65

The California Office of Environmental Health Hazard Assessment (OEHHA) has recently issued¹ a new Safe Use Determinations (SUD) for exposures to Bisphenol A (BPA) from certain polycarbonate eyewear products under Proposition 65.

The eyewear products covered by this new SUD are prescription glasses, over-the-counter (OTC) reading glasses, non-prescription sunglasses, and safety glasses that manufactured, distributed or sold by the Vision Council member companies. These specified products are not required a Proposition 65 warning for exposures to BPA.

Back to March 2019, we have reported² that the Vision Council (TVC)³ submitted the request of a SUD for exposures to BPA on behalf of their member companies. TVC provided data and exposure analysis showing that the exposures to BPA from their products do not present significant risk of birth defects or reproductive harm. They requested OEHHA to have a best dertermination to reinforce their claim.

OEHHA evaluated and concluded that the estimated BPA dermal exposure is lower than the maximum allowable dose level (MADL) of 3 µg per day based on the experimental data provided by TVC. Therefore, OEHHA determined these specified eyewear products would not require a Proposition 65 warning for exposures to BPA and finally issued the SUD⁴
