UK: Designated standard updates proposed for toys

AUGUST 2022 - TOYS AND CHILDREN'S PRODUCTS

On 3 August 2022, the United Kingdom (UK) Department for Business, Energy and Industrial Strategy (BEIS) issued the first notice of the proposal to publish (No. 0063/22)1 new designated standards in support of the Toys (Safety) Regulations 2011 (S.I. 2011/1881)2.

The notice sets out proposals that the following standards are adopted that will give a presumption of conformity with the UK Toys Regulations:

Standard title

NEW version Superseded version
Safety of toys – Part 2: Flammability

EN 71-2:2020

EN 71-2:2011+A1:2014
Safety of toys – Part 3: Migration of certain elements

EN 71-3:2019+A1:2021
(See note 1)

EN 71-3:2019
Safety of toys — Part 4: Experimental sets for chemistry and related activities
EN 71-4:2020 EN 71-4:2013
Safety of toys – Part 7: Finger paints - Requirements and test method EN 71-7:2014+A3:2020 EN 71-7:2014+A2:2018
Safety of toys — Part 12: N-and N-nitrosatable substances EN 71-12:2016
(See note 2)
EN 71-12:2013
Safety of toys — Part 13: Olfactory board games, cosmetic kits and gustative games EN 71-13:2021 EN 71-13:2014
The UK designated standards list3 will be amended to show the above standards and the previous standards will be deleted after the publication date.

The references will be published to designate the standards on day 29 unless the proposal is withdrawn or amended before that date, or an objection to designation is received. This gives an expected date of 1 September 2022.

The adoption of these standards will bring the UK in line with the harmonised standards already referenced in the EU. However, there is no mention of the new electrical standard EN IEC 62115:2020+A11:2020 for electrical toys which is assumed to be still awaiting designation.

Note 1: The interpretation of clause 7 of the standard should be taken to require that test portions should not be made up of combined materials prior to the migration and analysis stages of the test.

Note 2: The limit values for N-nitrosamines and N-nitrosatable substances given in the EN 71-12:2016 are lower than the compliant level set in the UK Toys Regulations.

Substances EN 71-12:2016 S.I. 2011/1881
N-nitrosamines 0.01 mg/kg
0.05 mg/kg
N-nitrosatable substances
0.1 mg/kg 1 mg/kg
