EU: public consultation on Terphenyl hydrogenated under REACH Annex XVII was launched

On 20 June 2022, the European Chemicals Agency (ECHA) launched the 1st public consultation1 on the proposal2 to restrict Terphenyl, hydrogenated under REACH Annex XVII.

Terphenyl, hydrogenated is listed on the REACH Substance of Very High Concern (SVHC) Candidate List for authorisation since 2018. Its main use is as a high-temperature heat transfer fluid (HTF). Other non-HTF uses include plastic applications, coatings, paints, inks, adhesives, sealants etc. The restriction report submitter concluded that the HTF use is via a closed-loop manufacturing system, but environmental emissions are still possible. Moreover, an unacceptable risk of the non-HTF for environmental use has been identified. Hence, a proposed restriction under REACH Annex XVII is required to reduce risks.

The public consultation will end on 20 December 2022, and the final opinion of ECHA is expected to be available by July 2023. After that, ECHA will send the final opinion to the European Commission (EC), which will decide on whether to include the proposed restriction in REACH Annex XVII.

Proposed exemption

The use and placing on the market as a heat transfer fluid, if that such sites implement strictly controlled closed systems with technical containment measures to prevent environmental emissions;

18 months after the date of entry into force (5 years after the date of entry into force for the use and placing on the market in plasticiser applications for the production of aircrafts and their spare parts)
