USA: Colorado bans PFAS in various products


On 3 June 2022, USA Colorado State Governor signed the bill HB 22-13451 to law. This bill aims to protect humans and the environment from exposure to perfluoroalkyl and polyfluoroalkyl substances (PFAS) chemicals. Many of the restrictions in the bill will go into effect as early as 2024.

The new law will ban PFAS intentionally added to various consumer products e.g. carpets and rugs, food packaging, juvenile products, furniture and cosmetics, and will require cookware with PFAS to be labelled. It will also regulate the uses and storage of firefighting foam. Table 1 summarizes the requirements and effective dates of the law.

  • oil and gas product

No one shall sell or offer for sale, distribute for sale or distribute in use for the products containing intentionally added PFAS chemicals.

On and after 1 January 2024

  • Cosmetics;
  • indoor textile furnishing;
  • indoor upholstered furniture

On and after 1 January 2025

  • Outdoor textile furnishing;
  • Outdoor upholstered furniture

On and after 1 January 2027


A) Cookware containing intentionally added PFAS shall: 

  • List the presence of PFAS chemicals on the product label;
  • Include a statement in both English and Spanish on the product label of the cookware to direct consumers to a website with information about the PFAS chemicals are intentionally added. 

B) Manufacturers of cookware shall not claim the cookware is free of PFAS chemicals unless no such chemical is intentionally added to the cookware.

On and after 1 January 2024

Class B firefighting foam containing intentionally added PFAS chemicals

The use of such firefighting foam is prohibited due to the risks of being released into the environment. The law also requires fully containing the firefighting foam during its use, safe storage and reporting certain information within 24 hours if there is a release.
