France: Final decision on Green Dot

JULY 2023 - ELECTRICAL AND ELECTRONICS, HARDLINES, SOFTLINES, TOYS AND CHILDREN'S PRODUCTS

On 30 June 2023, after two years of processing, the French Supreme Administrative Court (the Conseil d'État) finally announced its decision¹ to annul the ordinances related to the restriction and penalty of the use of the "Green Dot" symbol in France. 

The use of the Green Dot symbol will thus remain voluntary in France and will not incur a penalty.

In Text No. 95 of JORF n°0155 of July 6, 2023², the below Ordinances are officially annulled:

• Ordinance of November 30, 2020³ relating to signs and markings which could lead to confusion on the rule for sorting or bringing in waste from the product
• Ordinance of December 25, 2020⁴ amending the Ordinance of November 29, 2016 relating to the approval procedure and the specifications of eco-organizations in the household packaging sector
