What is Regulation (EU) 2018/858?

Regulation (EU) 2018/858 came into force on 1st September 2020. The regulation covers the approval and market surveillance of motor vehicles and their trailers, as well as systems, components and separate technical units intended for such vehicles.

Regulation (EU) 2018/858 is applicable in all EU Member States and recognises that there is a need to introduce market surveillance to complement type approval requirements. The new regulation incorporates most of the type approval provisions set out in Directive 2007/46/EC, which Regulation (EU) 2018/858 has replaced.

Regulation (EU) 2018/858 now covers the administrative and technical requirements for type approval and placing on the market, as well as market surveillance conditions. These additional safeguards are intended to ensure the compliance of vehicles, vehicle parts and vehicle systems with the approval requirements. It enhances and extends existing EU automotive regulations.

Why is Compliance with Regulation (EU) 2018/858 Important?

Since 1st September 2020 it has been mandatory for each EU Member State to perform market surveillance tests. Therefore a national market surveillance agency must be established in each member state in order to coordinate and perform these tests. The number of required mandatory tests is specified as a proportion of the total number of vehicle registrations within a country each year and complements the type approval requirements.

What market surveillance requirements does Regulation (EU) 2018/858 introduce?

Regulation (EU) 2018/858 requires the market surveillance authority in every EU member state to perform a mandatory number of test each year. The tests verify the compliance of vehicles, vehicle parts and vehicle systems with the approval requirements. Vehicles must be assessed against a wide range of requirements including safety and environmental parameters, from electronics to emissions to material flammability.
