USA: CPSC finalises ban of crib bumpers

On 14 August 2023, the Consumer Product Safety Commission (CPSC) issued a final rule1 to codify the bans on crib bumpers established in the Safe Sleep for Babies Act (SSBA)2, which Congress passed in 2022. The rules will guide the Commission’s enforcement of the law going forward.
The CPSC codifies the SSBA's mandate and considered the crib bumpers a banned hazardous product under section 8 of the Consumer Product Safety Improvement Act (CPSIA). Although the final rule will not be effective until 13 September 2023, the manufacture and sale of crib bumpers have been prohibited since 12 November 2022.
A crib bumper is defined as any material intended to cover the sides of a crib to prevent injury to any crib occupant from impacts against the side of the crib or to prevent partial or complete access to any openings in the sides of a crib to prevent a crib occupant from getting any part of their body trapped in any opening.
Included in the definition of a crib bumper are padded crib bumpers, supported and unsupported vinyl bumper guards and vertical crib slat covers. Non-padded mesh crib liners are not included in the commission’s definition.
