These services aim to enhance reliability, safety, security, quality, environmental protection, and profitability for our customers. The term “services” below refers to these offerings.)

③ Handling of Personal Information
⑴ When collecting personal information, we will clearly notify the purpose of collection and obtain consent, and collect and use the information only within the necessary scope. Consent is deemed to have been given upon agreement to this Privacy Policy.

⑵ We may share collected personal information within our company and the TÜV SÜD Group (including TÜV SÜD AG and its affiliates) for the purposes stated in section ②. Shared information may include name, organization/company name, job title, address, telephone number, fax number, and email address. Our company will act as the administrator for such shared use.

④ Proper Management of Personal Information
We will maintain collected personal information accurately and up to date, and implement reasonable security measures such as preventing unauthorized access, loss, destruction, alteration, or leakage, as well as employee training and corrective actions as necessary.

⑤ Withdrawal of Consent
Before providing the services listed in section ②, we obtain your consent regarding the use of personal information. You may withdraw this consent (stop providing information) at any time by contacting us at the address listed in section 1.

⑥ Disclosure to Third Parties
We will not provide, disclose, sell, or share your personal information with third parties (excluding our company and TÜV SÜD Group companies) for purposes other than those stated in section ②, nor for commercial purposes.
However, we may provide personal information to contractors within the scope necessary to achieve the purposes stated in section ②. In such cases, we carefully select contractors, conduct regular audits, and require them by contract to comply with the Act on the Protection of Personal Information and the EU General Data Protection Regulation (GDPR), maintain strict confidentiality, use the information only for agreed purposes, and follow our reasonable instructions. Our company assumes responsibility for such use.

⑦ Security
We implement appropriate physical, technical, and organizational measures to protect personal information provided by customers against accidental or intentional manipulation, loss, destruction, or unauthorized access. This applies to external services we partner with as well. We continuously review and improve our data protection measures in line with technological developments. Personal information entered by customers is encrypted and transmitted securely.

⑧ Requests for Disclosure, Correction, Deletion, Addition, Suspension of Use, and Complaints
If you request disclosure (including records of third-party provision), correction, deletion, addition, suspension of use, or file a complaint regarding your personal information held by us, we will confirm your identity and respond within a reasonable period and scope in accordance with applicable laws and this Privacy Policy. We manage and operate this website in accordance with this Privacy Policy to ensure customers can browse and use online downloads securely.

⑩ Processing of Information
To transmit website content (such as text, images, downloadable files) to your computer, we record and store your computer’s IP address. The purpose of this data processing is to ensure the functionality of operations conducted through this website.

2.1. Cases Where We May Contact You for Special Reasons
To respond to your inquiry submitted via the contact details specified in Section 1 or through our online contact form in the best possible way, we may contact you based on our legitimate interests. For this purpose, we require your email address, surname, given name, job title, company name, and information about the corresponding country/region.

In certain cases, handling your inquiry may require cooperation with other TÜV SÜD entities. To process your inquiry in the most effective manner, we may transfer relevant data to another entity within our company and the TÜV SÜD Group (including TÜV SÜD AG and its affiliates) in accordance with Section ③(2).

2.2. Cases Where Our Group Companies May Contact You for Special Reasons
Through this website, you may contact other TÜV SÜD Group entities. You can reach a specific TÜV SÜD entity by telephone, email, completing a contact form, requesting materials, or submitting a quotation request.
In such cases, the TÜV SÜD entity that receives your inquiry or request will act as the data controller responsible for processing your data. If there is a possibility that you will contact that TÜV SÜD entity, we will provide you with concise information about the relevant controller. After you transmit your data, the TÜV SÜD entity that receives it will process the data accordingly.

2.3. Newsletter registration
Our company distributes newsletters, and for this purpose, we may use the personal information obtained from customers at the time of registration.

2.4. Links to social networks
Our website uses social media buttons. The buttons show the logos of the respective social network. Please note that these buttons are only icons with embedded links. They are not social plugins. When you click one of these buttons, you leave our website and thus our sphere of responsibility. 

2.5. Webinars
On our website, we offer the possibility to attend webinars. These webinars are offered by individual or several TÜV SÜD companies. The information about the company offering the webinar can always be found in the event details or the registration form. Register for a webinar using the respective registration form. The data that you submit in this form will only be used for webinar organization and will be subsequently deleted. 

2.6. Privacy Information for Online Examinations (TÜV SÜD CertBay)
As part of fulfilling contractual obligations or taking steps prior to entering into a contract (in accordance with GDPR Article 6(1)(b) and 6(1)(f)), TÜV SÜD processes candidates’ personal data in connection with online examinations conducted via the TÜV SÜD CertBay platform.

Use of Cookies on TÜV SÜD CertBay.TÜV SÜD CertBay uses cookies. Cookies are small data packages (text files) stored on your device by your browser at the instruction of the website you visit, used to retain information. These cookies are set by us and are referred to as first-party cookies. In the case of CertBay, these are session cookies (random strings of numbers and letters).

These cookies are essential for the basic functionality of the website and cannot be disabled in the system. Typically, they are set in response to actions you take, such as selecting data protection settings, logging in, or filling out forms. You can block or receive notifications about these cookies through your browser settings; however, doing so may cause some functions to operate incorrectly. These cookies do not store personal data.

Disclosure in Specific Cases.In certain cases, as part of examinations conducted by TÜV SÜD Akademie GmbH, candidates’ personal data may be provided to certification bodies or examination authorities (e.g., government agencies, accreditation bodies, public employment offices).

Use of External Service Providers.For service delivery, particularly for IT system provision, maintenance, and management, we use external service providers under contractual agreements.

Transfer to Third Countries.Personal data is generally not transferred to third countries. Exceptions apply only to data related to participants and clients based in third countries.

Data Retention.Personal data that is no longer required for fulfilling contractual or legal obligations is regularly deleted, typically after 10 years. However, data may continue to be processed in a limited manner where necessary to achieve purposes based on legitimate interests.

Matomo
We use Matomo (formerly known as Piwik), a web analytics service that analyses users’ browsing behaviour. Matomo software is supplied by InnoCraft Ltd., 150 Willis St, 6011 Wellington, New Zealand.

The statistics collected help us to improve our offer and make the website more interesting for you as a user. To this end, we process your truncated IP address and information about the pages of our website which you have accessed, about your browser and the time you have spent on our pages.

We use Matomo with the “Automatically anonymize visitor IPs” setting. This means IP addresses are not stored in full. Instead, 2 bytes from the IP address are masked (e.g. 192.168.xxx.xxx), making it impossible to trace the truncated IP address back to the computer used to access the website.

Users’ interest in the protection of their personal data is sufficiently taken into account through anonymisation of IP addresses, hosting on our company’s own servers, and the fact that we do not transfer any data to Matomo. These data will be erased as soon as they are no longer needed for the purposes for which we collected them or if you withdraw your consent.

Visitor analytics

Use of Google Analytics

Use of Adobe Analytics
We use Adobe Analytics, supplied by Adobe Systems Software Ireland Limited, 4-6 Riverwalk, Citywest Business Campus, Saggart, Dublin 24, Ireland, to analyse our users‘ browsing behaviour. Some pages of our website use Drift, a service provided by Drift.com, Inc., 222 Berkeley St, 7th Floor, Boston, MA 02116. Use of Google Ads: 
This website uses Google Ads, an advertising system from Google Inc. (“Google”), to promote our website. Google Ads is operated by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA). 

Google Ads is an online advertising program by Google that allows businesses to place ads to reach their target audience. In addition to displaying targeted ads, we use Google Ads to implement retargeting strategies. Retargeting allows us to show advertisements to consented users who have previously visited our website, encouraging them to return and complete a desired action, such as making a purchase. The cookies mentioned earlier, are instrumental for that, as they are part of the process for tracking user interactions, which enables us to display relevant ads across the web. We cannot determine a visitor's identity from the data collected through Google Ads for the retargeting function. Google processes this data in a pseudonymised manner, meaning it does not access the user’s name or email address and only processes visit-related information stored in the cookie. We ourselves do not collect or process any personal data in the mentioned advertising activities. We only receive aggregated statistical reports from Google. Based on these reports, we can see which of the advertising measures used are particularly effective. We do not receive any further data from the use of the advertising tools, and we cannot identify the users based on this information.

At this point, we would like to note that we have no control over how Google further uses the data collected. Google acts as an independent data controller: Google is responsible for the further processing of data collected through Google Ads and may use this data for its own purposes in accordance with its privacy policy (Privacy Policy – Privacy & Terms – Google).
