About California Proposition 65

Products must comply with California’s Safe Drinking Water and Toxic Enforcement Act (also known as CA Prop 65). The 1986 law aims to protect drinking water sources from contamination by chemicals and other toxic substances linked to cancer, birth defects and reproductive hazards. Companies conducting business within the state must provide consumer warnings in connection with products containing or exposing any one of almost 900 listed chemicals and substances.

The list of chemicals [source:oehha.ca.gov] deemed hazardous is long and updates are made often. Whether a product is established or new to market, businesses should verify whether it is compliant with the law to ensure market access to California. Failure to comply with requirements can lead to civil penalties of up to $2,500 per violation per day.
