The New York Department of Environmental Conservation (DEC) has published its Final Program Policy1 for annual reporting of organohalogen flame retardants in electronic displays. As we reported2 earlier in January 2022, New York passed the law to regulate flame retardants for specific products. By 31 December 2022, manufacturers who sell their products in the State must report the presence of organohalogen flame retardants in the enclosures or stands of their electronic displays.
According to the New York law, electronic displays refer to a consumer product with a display screen and associated electronics that, as its primary function, displays visual information from wired or wireless sources and is available for purchase by individuals or households for personal use in a residential space, for examples, computer or video game monitors, televisions, portable DVD players, tablets, etc.. According to the Final Program Policy, a manufacturer must submit its annual report using the forms determined by the DEC which are attached in Appendices A3 through E. The detailed information e.g. contact and product details required can be found in Appendix B. As optional information, the DEC is requesting the information on the concentration ranges of all organohalogen flame retardants used in the products.
Each annual report must cover all products sold or offered for sale or products which will be offered for sale by a manufacturer during the current calendar year. The DEC will accept reports between 1 November and 31 December annually and the reports are due by 31 December each year, starting in 2022. It is worthy to note that the prohibition of electronic displays containing organohalogen flame retardants will start from 1 December 2024.
