korea: radio act amendment on self-assessment and local representatives for conformity assessments
APRIL 2024 - ELECTRICAL AND ELECTRONICS
On 23 January 2024, the Korean Ministry of Science, Information Technology and Future Planning issued an amendment (Act No. 20067, 2024) to the Radio Act.
This amendment is to introduce self-conformity confirmation into the conformity assessment system and establish requirements for overseas manufacturers to designate domestic agents and report non-conforming equipment.
According to the Article 58-2, self-confirmation is applicable to anyone who intends to manufacture, sell or import equipment which has a low risk of causing harm to the radio environment or broadcasting communication network. It is also accepted to have the test done by a designated testing agency to prove that the equipment complies with the conformity assessment standards.
In case of overseas manufacturers who intend to apply for self-conformity confirmation assessment, it is specifies that a person with a domestic address or business office must be designated as a local representative, and a fake designation may result in the cancellation of the conformity assessment according to Article 58-13.
The amendment enters into force on 24 July 2024.
