USA: Illinois expands PFAS ban to certain consumer products

August 2025 - Hardlines, softlines, toys and children's products

The U.S. state of Illinois has taken a significant step toward eliminating perfluoroalkyl and polyfluoroalkyl substances (PFAS) from consumer goods. The Governor of Illinois has recently signed1 House Bill 25162 into law, which expands the state's existing PFAS Reduction Act3. The amendment will prohibit the sale and distribution of several common household products that contain intentionally added PFAS, driving a market shift toward safer alternatives.

Beginning 1 January 2032, no company may sell, offer for sale, or distribute for sale the following products in Illinois if they contain intentionally added PFAS:

  • Cosmetics;
  • Dental floss;
  • Juvenile products;
  • Menstrual products;
  • Intimate apparel.

This new law builds upon the state's existing ban on Class B firefighting foam containing intentionally added PFAS. It further defines "intentionally added PFAS" as chemicals deliberately included during a product's manufacturing process to serve a specific function in the final product. However, the ban does not apply to electronic or internal components, used products offered for sale or resale and other exemptions specified in Section 45(b) of PFAS Reduction Act.

In case of violations of the law, that can result in civil penalties, with fines of up to $5,000 for a first offense and up to $10,000 for each subsequent violation.
