Brazil establishes new import procedure for telecommunications products under SISCOMEX - Act no. 18086/2025

On 25 November 2025, the Brazil National Telecommunications Agency (ANATEL) issued Act No. 18086, establishing the operational procedure for the administrative processing of imports of telecommunications products subject to ANATEL approval through the Integrated Foreign Trade System (SISCOMEX).
ANATEL approval is mandatory for the use and commercialization of telecommunications products in Brazil. Products included in the Reference List of Telecommunications Products must obtain prior approval before importation, except in the following situations:
- Samples imported exclusively for conformity assessment testing.
- Products that do not emit radio frequency signals and are temporarily present in Brazil for purposes such as demonstration, exhibition, characterization, or transit.
- Products covered by Temporary Spectrum Use authorizations.
- Products covered by authorizations for Special Services for Scientific and Experimental Purposes, or any equivalent authorization that may replace them.
- Products imported for use or consumption in the manufacture of export goods, provided they are admitted under a specific customs special regime established for this purpose.
For regulatory purposes, the importation of telecommunications products is classified into the following categories:
- Importation of approved products for use and/or commercialization.
- Importation of products for the importer’s own use.
- Importation of product samples for conformity assessment.
- Importation of products for demonstration purposes.
Importation of Approved Telecommunications Products
Only the certificate holder, or its legally authorized representative, may import approved telecommunications products into Brazil. Each product must bear the ANATEL certification mark in accordance with the applicable marking requirements.
To facilitate customs clearance and regulatory oversight, the corresponding ANATEL certificate number must be declared in the “Additional Information” section of all import documentation.
Importation of Product Samples for Conformity Assessment
Under the new procedure, product samples may only be imported in quantities necessary to conduct certification testing. Any unused samples must be retained until the final certificate of conformity has been issued.
The release of product samples is subject to a formal service agreement between the importer, or prospective certificate holder, and either an ANATEL-designated certification body or an authorized testing laboratory. The agreement must clearly identify the product model, manufacturer, and the quantity of samples to be evaluated.
All imported samples, including those shipped via postal services or courier companies, remain subject to compliance inspections conducted by ANATEL and the Brazilian Federal Revenue Service.
Act No. 18086 entered into force on 25 May 2026 and repeals Resolution No. 715/2019.
