On 25 November 2025, the Brazilian National Telecommunications Agency (ANATEL) issued Act No. 18086 of 2025, establishing the operational procedures for processing import operations of telecommunications products requiring ANATEL approval within the Integrated Foreign Trade System (SISCOMEX).
Key Points:
- ANATEL Approval Required: Certification by ANATEL is mandatory for the use and commercialization of telecommunications products. Prior approval is required before importation for products listed in the Reference List of Telecommunications Products, except in certain cases, including:
- Samples for conformity testing
- Products that do not emit radiofrequency, are in transit, or temporarily in the country for demonstration, exhibition, or characterization
- Products authorized for temporary spectrum use
- Products authorized for special scientific or experimental services
- Products imported for domestic use in the manufacture of goods for export under a special customs regime
- Permitted Import Purposes:
- Import of approved products for use and/or commercialization
- Import for personal or company use
- Import of product samples for conformity assessment
- Import for demonstration purposes
- Import of Approved Products: Only the certificate holder, or their legal representative, may import certified telecommunications products. Each product must bear the ANATEL certification mark according to the established marking procedures. The certificate number must also be included in the “Additional Information” field on all import documentation to facilitate customs clearance and regulatory oversight.
- Import of Product Samples for Conformity Assessment: Samples may only be imported in quantities necessary for certification testing. Remaining samples must be retained until the final certificate of conformity is issued. Import and testing require a formal service agreement between the importer (or eventual certificate holder) and an ANATEL-designated certification body or authorized testing laboratory. The agreement must specify the product model, manufacturer, and exact quantity to be evaluated. All shipments, including those via post or courier, are subject to inspections by ANATEL and the Brazilian Federal Tax Agency.
Implementation: Act No. 18086 will come into force on 25 May 2026, at which time it will repeal Resolution No. 715 of 2019.
