What is Regulation (EU) 2018/858?

Regulation (EU) 2018/858 came into force on 1st September 2020. It applies to motor vehicles and their trailers, as well as systems, components, and separate technical units intended for such vehicles. Regulation (EU) 2018/858 is applicable in all EU Member States and recognises that there is a need to introduce market surveillance to complement type approval requirements. The new regulation incorporates most of the type approval provisions set out in Directive 2007/46/EC, which Regulation (EU) 2018/858 has replaced. It covers the administrative and technical requirements for type approval and placing on the market, as well as market surveillance conditions.

The regulation requires each EU member state market surveillance agencies to verify compliance by coordinating and performing mandatory tests each year. Vehicles must be assessed against a wide range of requirements. This includes safety and environmental parameters, such as electronics, emissions, and material flammability. The number of tests is specified as a proportion of the total number of vehicle registrations within a country each year.
