For many this has been a question with no clear answer! Section 6 of the Health & Safety at Work Act (HSW) places a clear duty to carry out, or arrange for the carrying out, of testing and examination as may be necessary to ensure that the article (equipment) is so designed and constructed that it will, as far as is reasonably practicable, be safe and without risks to health.
