Regulatory Update: Changes in the Use of the Radio Spectrum in Chile

On 25 April 2023, the Chilean Ministry of Transport and Telecommunication (MTT) published Decree No. 192 of 2022, which modifies Decree No. 127 of 2006, approving the General Plan for the Use of the Radio Spectrum. This plan defines the allocation and regulation of the electromagnetic spectrum into radio frequency bands for different services and applications.

The main changes introduced by the new Decree are:

  • The replacement of the "Frequency Band Allocation Chart" in Article 4, Section IV, with a new one that specifies the frequency ranges and services assigned to each band.
  • The introduction of "Notes to the Table of Allocation of Frequency Bands" in Article 4, Section V, which provides additional information and conditions for some bands and services, such as:
    • The maximum radiated power of 25 W EIRP for amateur stations using the frequency band 5,351.5 - 5,366.5 kHz.
    • The protection of the television broadcasting service from harmful interference caused by the sound broadcasting service in the 76 - 88 MHz frequency band.
    • The sharing between the fixed-satellite service (Earth-to-space) and the broadcasting satellite service in the 17.3-17.8 GHz band in accordance with international regulations.
    • The modification of note 204 of Article 4, Section V, which clarifies that the fixed-satellite service (space-to-Earth) in the band 17.7-17.8 GHz shall not cause harmful interference or claim protection against assignments of the broadcasting-satellite service operating in accordance with the Radio Regulations.

These changes aim to update and harmonize the spectrum management in Chile with international standards and best practices, as well as to promote the efficient and flexible use of this scarce resource for social and economic development.

Manufacturers who use or intend to use radio equipment or applications that operate in the affected frequency bands should be aware of these changes and comply with the new rules and conditions established by the MTT.
