Canada: Health Canada considering changes to the tents regulations

JULY 2023 - HARDLINES, SOFTLINES, TOYS AND CHILDREN'S PRODUCTS

Health Canada has proposed changes1 to the Tents Regulations2 to improve the safety of tents and children's play tents distributed in Canada. Interested parties can provide their comments on the proposal by 26 August 2023.

The proposed revisions include:

  • Replacing the current CPAI-84 (1995) standard with CAN/CGSB-182.1-20203 on the flammability and labelling requirements for tents.
  • Adding flammability performance and fire-safety labelling requirements to the Toys Regulations4 with reference to ISO 8124-2 and continue regulating children's tents that provide shelter outdoors, such as camping tents, sun shelters and play tents that resemble camping tents.
  • Excluding certain children’s play tents that do not provide outdoor shelter from the Tents Regulations and Textile Flammability Regulations5, as they will be regulated under the Toys Regulations.
  • Updating the definitions of plush toys, soft toys and toys intended to be entered by a child in the Toys Regulations. The proposed definition would encompass toys such as play tunnels, teepees and bed tents that share similar characteristics to a play tent and provide partial to a full enclosure.
  • A transitional period of 365 days following the date on which the proposed regulations come into force would be provided to allow the industry to deplete existing stocks that comply with the existing Tents Regulations and Toys Regulations.
