Brazil: ANATEL Act No. 14430/2024 Requires VoLTE Support and Bans 3G-Only Certification

Effective on 6 April 2025

On 9 October 2024, Brazil’s National Telecommunications Agency (ANATEL) enacted Act No. 14430/2024, amending Act No. 3151/2020 (Technical Requirements for Conformity Assessment of Terminal Access Equipment) and Act No. 3152 (Mobile Cellular Phone Standards). The update accelerates the transition from legacy 3G networks to advanced 4G/5G technologies by imposing new certification requirements for telecommunications devices.

Key Provisions:

1. Prohibition of 3G-Only Device Certification

• Terminal Access Equipment: Manufacturers, vendors, or businesses are prohibited from certifying modules or final products classified as Personal Mobile Service Terminal Stations that exclusively support 3G or older technologies (Article 1, 4.4)
• Mobile Phones: Certification of mobile phones compatible solely with 3G or earlier technologies is no longer permitted (Article 2, 4.5).

2. Mandatory VoLTE and IMS Support

• Terminal Access Equipment: Devices capable of voice calls must support VoLTE (Voice over LTE) for emergency and standard calls, as well as SMS exchange via IP Multimedia Subsystem (IMS) (Article 1, 4.5).
• Mobile Phones: All handsets must enable VoLTE functionality (including emergency calls) and SMS over IMS (Article 2, 4.6).Prohibition of 3G-Only Device Certification

3. Grandfathering of Existing 3G Devices

• Pre-certified 3G-compatible equipment approved before 6 April 2025 may retain their certifications without retroactive compliance with the new standards (Article 3).
