USA: New York bans PFAS in apparel

The New York state has passed the bill A70631 to phase out the use of perfluoroalkyl and polyfluoroalkyl substances (PFAS) in apparel. Now New York and California are the first two states to ban PFAS in apparel.

Effective from 31 December 2023, no person shall sell or offer for sale in New York any apparel containing PFAS as intentionally added chemicals. Apparel falling within the scope of the bill is defined as clothing items intended for regular wear or formal occasions including, but not limited to, undergarments, shirts, pants, skirts, dresses, overalls, bodysuits, vests, dancewear, suits, saris, scarves, tops, leggings, leisurewear, formal wear, onesies, bibs and diapers. However, professional uniforms or outerwear intended for extreme conditions are excluded from the scope.

In September 2022, California passed a bill (AB 18172) to ban the use of PFAS in apparel and textile articles, which becomes the first state law to ban PFAS in apparel. Now New York is joining California to phase out the use of PFAS in apparel. Besides this ban on apparel, New York already enacted bills to phase out the uses of PFAS in firefighting foam3 and food packaging4.
