JULY 2020 – RELEVANT FOR: CHILDREN'S PRODUCTS, HARDLINES
The Consumer Product Safety Commission (CPSC) has recently published a final rule for 16 CFR part 12391 establishing a new mandatory safety standard for children’s gates and enclosures in Federal Register.
Effective 6 July 2021, these gates and enclosures shall comply with the applicable ASTM standard F1004-192 with modifications. The final rule addresses all children’s gates and enclosures intended for confining a child age 6 months through 24 months, including non-expandable, fixed-sized gates and enclosures.
The modifications mainly include additional warning requirement for pressure-mounted gates with wall cups and side-pressure indicators requirement for pressure-mounted gates without wall cups. These modifications aim to further reduce the risk of injury associated with incorrectly installed pressure-mounted gates.
Gates and enclosures for confining a child have been identified as durable infant or toddler products and they are subject to the consumer registration requirement under 16 CFR part 1130.
