As known, California Proposition 65 (Prop 65)1 enforcement is carried out through civil lawsuits which brought by the California Attorney General’s Office (OAG), or by a district attorney or city attorney. Private parties acting in the public interest are also allowed to bring Prop 65 lawsuits.
Effective 30 August 2018, businesses must comply with the new warning requirements for the exposures to any chemical in the Proposition 65 list. There are approximately two months until the effective date. Businesses must now review their warning statements2 used in supply chain and ensure the new products manufactured after the effective date comply with the new requirements.
Recently, the OAG reported several new settlements for the lawsuits of Prop 65 violations. Involved products range from cell phone accessories, utensils, heat sensitive receipt paper to electronics. The summary of the new settlements is in Table 1 below.
