Registration, Evaluation, Authorisation and Restriction of Chemicals
The EU chemicals regulation REACH has been in force since June 1, 2007. It fundamentally changed European chemicals law. Based on the REACH regulation, chemical substances had to be registered with the "European Chemicals Agency" (ECHA) within certain deadlines. According to the REACH Regulation, non-registered substances and mixtures containing such substances may no longer be placed on the market within the EU. The only exceptions are substances manufactured or imported in quantities of less than 1 t/a.
In addition to manufacturers, it also directly affects importers and users of substances and mixtures. An authorization for placing particularly hazardous substances on the market or using them must also be applied for. This concerns in particular so-called downstream users, i.e. those actors who purchase these substances from EU/EEA-based suppliers. The need for authorization is independent of the annual quantity, i.e. also concerns quantities < 1 t/a.Furthermore, extensive supply chain communication and reporting obligations to ECHA apply. Safety data sheets must be successively amended.

Important: The obligation to register still exists. It applies to all substances manufactured or imported for the first time after 31.05.2018 (last of the three relevant REACH registration deadlines) from 1 t/a, e.g. new substances.
