WHAT DOES THE NOTIFICATION REQUIREMENT FOR HAZARDOUS MIXTURES ENTAIL?

Anyone who markets chemical products that are hazardous to health in Europe must clearly label them by 2021 and report their composition to poison control centers or the European Chemicals Agency (ECHA). This is being done as part of the harmonisation of emergency health care in the EU. For this purpose, the Regulation on Classification, Labeling and Packaging of Substances and Mixtures has been amended accordingly. With the Unique Form Identifier (UFI), poison control centers will then have all the information they need to provide rapid assistance in an emergency.

The Poison Center Notification (PCN) contains information on composition and toxicology, trade name, color and packaging details - as well as a 16-digit unique formulation identifier, the UFI. By 2025 at the latest, this code must be printed on the labels or in the safety data sheets of all hazardous mixtures. Especially in the case of mixtures for commercial use, there is currently still a lot of catching up to do.

In the past, poison control centers often did not have enough information about the hazard potential of a hazardous mixture, because importers and distributors do not always know the composition of their products themselves. Non-European manufacturers are sometimes reluctant to disclose these trade secrets to their customers for fear of plagiarism and product piracy.

To avoid straining business relationships and still make all necessary information available, companies can now use trustees in such cases. An independent and knowledgeable third party collects the data, reports the mixture to the European Chemicals Agency (ECHA) and deposits the PCN with the Poison Control Center. In this way, distributors fulfill their obligations and the manufacturer's confidential information remains protected. This is because the UFI does not allow any conclusions to be drawn about the ingredients. Only the poison control centers receive the detailed information.
