2025年5月16日,印度通訊部正式啟用依據《2023年電信法(Telecommunications Act, 2023)》制定的新認證制度,標誌著印度電信產品合規流程邁入現代化。該法規名稱為《2025年電信標準公告、符合性評估與認證制度規則》(Telecommunications (Framework to Notify Standards, Conformity Assessment and Certification) Rules, 2025),並取代原自1951年沿用至今的《印度電報規則》。

此次變革明確劃分責任權限、提升審查強度,對於希望進入印度市場的製造商來說,是一次全面性的制度更新。

  • 政府指定主管機關,明確合規責任

根據新規定,電信工程中心(TEC)與國家通訊安全中心(NCCS)被正式授權為電信標準制定與管理的主管機構。

制度重點如下:

  1. 所有產品測試須透過認證的符合性評估機構(CABs)進行。
  2. CABs 可設立於印度國內或國際地區,但不得設於與印度接壤的國家。
  3. 認證須定期更新,逾期即失效。
  4. 未具有效認證的產品不得進口、部署或銷售。

製造商因此須遵循更嚴格的技術與流程要求,以確保符合法規。

  • 數位平台集中認證資訊,提升透明度

新制度也推出一個官方線上入口平台,集中提供標準與認證相關資訊,簡化申請程序並加強公開透明。

針對所有擬新增的技術標準,政府規定須進行60日公開諮詢期,除非屬緊急情況。這讓製造商、產業團體與使用者得以參與法規形成過程,打造更具合作性與包容性的監管環境。

  • 哪些產品可免除認證?

儘管規定更趨完整,仍保留部分產品類型的豁免條件,包括:

  1. 用於測試、研發、展示或監理沙盒的設備
  2. 僅供個人使用的設備
  3. 已獲認證機型的同款變形產品(如僅標籤不同)

不過,製造商應謹慎評估產品是否真正符合豁免條件,避免誤判而造成違規風險。

 

 

India: New Regulatory Framework Effective from 2025

On May 16, 2025, India’s Ministry of Communications formally implemented a new certification framework under the Telecommunications Act, 2023, replacing outdated procedures from the Indian Telegraph Rules of 1951. This reform, officially titled the Telecommunications (Framework to Notify Standards, Conformity Assessment and Certification) Rules, 2025, represents a major step forward in modernizing the country's telecom compliance system.

The update introduces clearer regulatory responsibilities, stricter technical requirements, and new procedural controls for all telecom equipment entering the Indian market.

  • Designated Authorities and Key Compliance Requirements

Under the new rules, the Telecommunication Engineering Centre (TEC) and the National Centre for Communication Security (NCCS) have been officially appointed as the leading authorities responsible for developing and overseeing telecom standards in India.

Key regulatory changes include:

  1. All testing must be conducted through accredited Conformity Assessment Bodies (CABs).
  2. CABs can be based either domestically or internationally, excluding countries that share a land border with India.
  3. Certifications must be renewed periodically to remain valid.
  4. Products without valid certifications may not be imported, deployed, or sold.

As a result, manufacturers are now required to meet stricter technical and procedural standards to access the Indian telecom market.

  • Centralized Certification Portal and Public Consultation Process

The new framework introduces a dedicated online portal, offering centralized access to all notified standards and certification details. This initiative enhances process efficiency and improves transparency for all stakeholders.

Furthermore, newly proposed technical standards must undergo a mandatory 60-day public consultation period, allowing manufacturers, industry bodies, and consumers to provide feedback. Unless an emergency justifies a faster rollout, no new standards may bypass this review.

This approach promotes a more collaborative and inclusive regulatory environment across the telecom sector.

  • Certification Exemptions: What’s Still Allowed?

Despite its comprehensive scope, the framework allows certain exemptions under specific conditions:

  1. Equipment imported for testing, R&D, demonstrations, or regulatory sandbox use.
  2. Devices intended solely for personal use.
  3. Products that are identical to a previously certified model, except for minor cosmetic or label changes.

However, manufacturers must carefully review exemption criteria to avoid incorrect assumptions and potential non-compliance penalties.
