A regulatory outlook in US, EU and India
A Food Contact Material (FCM) refers to any material that comes into contact with food. This encompasses items like packaging, dishes, cutlery, cooking utensils, and materials used in food production and transportation. Ensuring the safety of food contact materials is crucial, as harmful substances could potentially migrate from these materials into the food itself.
In the European Union (EU), all food contact materials must comply with Regulation (EC) No 1935/2004 and separate, material-specific regulations. Additionally, EU Regulation No 2035/2006 applies to the production process of food contact materials. Further, FCMs must undergo testing to prevent excessive migration of harmful substances from the material to the food. These tests screen for chemicals that endanger human health and substances that may alter the food’s taste, smell, or appearance.

Dr. Robin Kumar
Manager, Laboratory (Chemical), TÜV SÜD South Asia
Dr. Robin Kumar currently works as a Manager, Laboratory (Chemical) at the Hardlines division of TÜV SÜD South Asia, since 2013. He is responsible for operations of the chemical laboratory at Gurugram, as per ISO 17025:2017.
With industry-rich experience across leading organizations, Dr. Kumar’s expertise lies in testing for food products, pharmaceutical products, and food contact materials (FCM). In his 16-year long career, Dr. Kumar has also worked extensively on consumer products, including fabric, yarn, home textiles, leather and hard goods to ensure consistent compliance measures across various quality parameters. In his current role at TÜV SÜD, he oversees technical / internal audits, new method development as per regulatory requirements for FCM and testing as per REACH, RoHS, and EU 10/2011.
Dr. Kumar also has several certifications conferred upon him by leading accreditation bodies & organizations, including CII, Agilent and Perkin Elmer among others.
