USA: EPA further postpones TSCA PFAS reporting deadlines
May 2025 - Electrical and electronics, hardlines, softlines, toys and children's products
The US Environmental Protection Agency (EPA) has published an interim final rule1 to postpone the deadlines of TSCA Section 8(a) per- and polyfluoroalkyl substances (PFAS) reporting. The new data submission date will start from 13 April 2026 and end by 13 October 2026, while small manufacturers can submit data until 13 April 2027 as an alternate end date.
This requirement affects anyone who has manufactured (including imported) a PFAS in any year from 2011 through 2022. This rule delays the start of the submission period by nine months from 11 July 2025 to 13 April 2026 and becomes effective immediately upon publication in the Federal Register on 13 May 2025.
The EPA has extended the deadline to allow additional time for the development and testing of the reporting application. This extension ensures that the technological capacity is in place to accept and process the data accurately.
