USA: Colorado added more products to PFAS ban

MAY 2024 - ELECTRICAL AND ELECTRONICS, HARDLINES, SOFTLINES, TOYS AND CHILDREN'S PRODUCTS

On 1 May 2024, the Governor of Colorado State signed the bill (SB 24-0811) to amend the requirements of perfluoroalkyl and polyfluoroalkyl substances (PFAS) ban and product disclosure.

In 2022, Colorado passed the bill HB 22-13452, which bans certain consumer products containing intentionally added PFAS and requires manufacturers of cookware with PFAS to disclose this information. The bill has been amended to expand the PFAS ban and remove the disclosure requirements for cookware. 

Below is the summary of amendments to Colorado PFAS requirements:

A. Information disclosure

  • The product disclosure requirements for cookware will be repealed from 1 January 2026;
  • Below disclosure of PFAS information for outdoor apparel for severe wet conditions is added.
  • Effective from 1 January 2025, no person shall sell, offer for sale, distribute for sale, or distribute for use an outdoor apparel for severe wet conditions product that contains intentionally added PFAS, unless the product is equipped with the phrase “Made with PFAS Chemicals”. 
  • This requirement will be repealed from 1 January 2028.

B. Prohibition
More bans on other products containing intentionally added PFAS are added:

1. Effective from 1 January 2026: 

  • cleaning products (except for cleaning products that are floor maintenance products used in hospital or medical settings);
  • cookware;
  • dental floss;
  • menstruation products;
  • ski wax;
  • installation of artificial turf.

2. Effective from 1 January 2028: 

  • cleaning products that are floor maintenance products used in hospital or medical settings;
  • textile articles; 
  • outdoor apparel for severe wet conditions;
  • food equipment intended primarily for use in commercial settings.
