CHINA: MANDATORY PRODUCT CERTIFICATION CATALOGUE AND IMPLEMENTATION REQUIREMENTS

China State Administration for Market Regulation (SAMR) issued Announcement No. 44 on 16 October 2019. The catalogue and associated implementation requirements of mandatory products are listed in this announcement. Three key points are:

• Changing the catalogue of mandatory product certification

18 products (see Annex 1) were removed from the range of the compulsory product certification management. Depending on company’s special requirement, the existing compulsory product certification can be altered into voluntary.

• Expanding the scope of implementation of self-declaration evaluation

17 types of products in the mandatory product certification catalogue (see Annex 2) were moved to the self-declaration evaluation scheme.

• Changing mandatory product certification implementation requirements

The launch of mandatory product certification will be terminated, and those products under compulsory product certification self-declaration evaluation scheme shall only use self-declaration evaluation. The enterprise should submit product compliance information into the “Self-Declaration Compliance Information Reporting System”. After the submission is confirmed, the submitter can be provided with a “Compulsory Certification Product Compliance Self-Declaration” (see example in Annex 3). This procedure implies that the compulsory product certification certificate is successful. The subsequent supervision and management requirements follow the same flow.

Important dates:

• 1 January, 2020

The launch of mandatory product certification will be terminated from this date, and product under self-declaration evaluation scheme shall only use self-declaration.

• 31 October, 2020

Products under self-declaration evaluation scheme that hold a compulsory product certification shall alter to self-declaration, and remove the compulsory product certification certificate by this date.
