EU: REACH Annex XIV now includes 43 substances

On 14 June 2017, the Official Journal of the European Union (OJEU) published Regulation (EU) No 2017/9991, which amended Annex XIV (Authorisation List) to REACH regulation. It is the 5th update of REACH Annex XIV, and 12 substances were added to the Authorisation List. The total number of substances on Annex XIV increases from 31 to 43.

According to REACH Regulation Article 56, the substances which are listed in the Annex XIV cannot be used or placed on the market after the “sunset date”, unless the authorisation is granted. The European Chemicals Agency (ECHA) recommends the priority substances to be included in the Annex XIV about every two years. These priority substances are chosen from the Candidate List. On 10 February 2014 and 1 July 2015, the ECHA submitted the 5th and the 6th recommendation of Authorisation List to the EC respectively. There were totally 20 substances of very high concern (SVHCs) in both recommendations (i.e. 5 SVHCs in the 5th recommendation and 15 SVHCs in the 6th recommendation). Finally, only 12 out of 20 SVHCs were included into the Annex XIV.

Remark:
PBT: substances which are persistent, bioaccumulative and toxic
vPvB: substances which are very persistent and very bioaccumulative
Latest application date: a date at least 18 months before sunset date by which applications must be received if the applicant wishes to continue to use the substance or place it on the market for certain uses after the sunset date; these continued uses shall be allowed after the sunset date until a decision on the application for authorisation is taken
Sunset date: the date from which the placing on the market and the use of the substance shall be prohibited unless an authorisation is granted
